The Game License and Service Agreement (hereinafter referred to as "this Agreement") is jointly entered into by you and DRAGONIS, and this Agreement has contractual effect. Please carefully read and fully understand the contents of each clause, especially the clauses that exempt or limit the liability of DRAGONIS (which usually contain words such as "no liability", "no obligation", "no guarantee"), clauses that restrict user rights (which usually contain words such as "not allowed", "should not", "no right"), clauses that agree on dispute resolution methods and jurisdiction, and separate agreements for opening or using a certain service. The aforementioned limitations, disclaimers, dispute resolution methods, and jurisdictional clauses may be highlighted in bold or in other reasonable ways to draw your attention.
If you are under 18 years old, please read this agreement with your guardian and pay special attention to the terms of use for minors.
1、 Definition
1.1 This agreement: refers to the main text of this agreement, the game rules, and their revised versions. Once the above content is officially released, it shall become an integral part of this agreement that cannot be separated. This agreement also includes the "Essential Terms of Format Agreement for Online Game Services" formulated by the Ministry of Culture in accordance with the "Interim Measures for the Administration of Online Games" (Ministry of Culture Order No. 49).
1.2 Game Rules: Refers to the user guidelines, player regulations, game announcements, and notices regarding the DRAGONIS software and DRAGONIS services that DRAGONIS publishes and revises from time to time.
1.3 DRAGONIS: Refers to DRAGONIS Co., Ltd., which provides you with DRAGONIS software and DRAGONIS services, referred to as "Douyu or DRAGONIS" in this agreement.
1.4 DRAGONIS Software: Refers to the general term for game products operated by DRAGONIS, including computer client games, web games, HTML5 games (H5 games), mobile terminal games, TV terminal games, and other product versions that can be run and operated on different operating systems and device terminals, as well as related network servers, websites, electronic media, printed materials, software, and related documents.
1.5 DRAGONIS Services: Refers to the various online operational services provided by DRAGONIS to you related to DRAGONIS Software, including the DRAGONIS Software itself.
1.6 You: Also known as "player" or "user", refers to a natural person authorized to use DRAGONIS services.
1.7 Game data: refers to various data recorded by the server during your use of DRAGONIS services, including game logs, security logs, and other data.
2、 Changes and Effectiveness of the Agreement
2.1 DRAGONIS has the right to change the terms of this agreement as necessary and notify on the relevant page. You can check the latest version of the agreement terms on the relevant pages of DRAGONIS Services.
2.2 After the terms of this agreement are changed, if you continue to use DRAGONIS Services, it shall be deemed that you have accepted the changed agreement. If you do not accept the revised agreement, you should stop using DRAGONIS Services.
3、 Game account
3.1 If you need to use and enjoy DRAGONIS services, you need to use your DRAGONIS account or other partner accounts recognized by DRAGONIS as your game account, and log in to the real name registration system and register according to the requirements of the "Interim Regulations on the Management of Online Games" and the "Essential Terms of the Standardization Agreement for Online Game Services" of the Ministry of Culture.
When you register with your real name, you should provide true, legal, accurate, and valid identity information and other relevant information about yourself, and you are not allowed to register with someone else's identity information. Otherwise, DRAGONIS has the right to terminate the provision of DRAGONIS services to you, and has the right to take measures on your game account, including but not limited to warning, restricting or prohibiting the use of all or part of the game account's functions, deleting the game account and game data, deleting related information, banning the game account (hereinafter sometimes referred to as "account suspension") until temporary cancellation (for the convenience of description, such measures are sometimes referred to as "punishment" below), and all consequences caused by this shall be borne by you.
3.2 You fully understand and agree that DRAGONIS will use your real name registration information in the anti addiction system in accordance with relevant national requirements. DRAGONIS may determine whether you are over 18 years old based on your real name registration information, and decide whether to impose anti addiction restrictions on your game account.
3.3 You should keep your game account safe, including keeping the password corresponding to your game account safe; You should notify DRAGONIS as soon as you become aware of the theft of your game account.
3.4 You fully understand and agree that in order to improve the security level of DRAGONIS Services, DRAGONIS has the right to apply relevant technologies or software to DRAGONIS Services. However, DRAGONIS does not guarantee that these security measures can completely eliminate the risk of game accounts being stolen or lost by others.
3.5 You fully understand and agree that if DRAGONIS restricts, freezes, or terminates the use of your game account in accordance with relevant business rules, it may result in the deletion of game data and related information under your game account, as well as the loss of related rights and interests. You shall be solely responsible for such losses, and DRAGONIS shall not be liable for any such losses.
3.6 You fully understand and agree that, in order to efficiently utilize server resources, if you have not used your game account to log in to the DRAGONIS software for a long time, DRAGONIS has the right to take necessary measures, such as deleting the account and its game data and related information, with prior notice. The above measures may result in the loss of your relevant rights and interests under the game account, and DRAGONIS shall not be held responsible for this.
4、 Collection, Use, and Protection of User Information/p>
4.1 You agree and authorize DRAGONIS to collect your user information for the purpose of fulfilling this agreement, including the information you registered in the real name registration system, game data under your game account, and other information you provide to DRAGONIS during the use of DRAGONIS services or that DRAGONIS needs to collect based on security, user experience optimization, and other considerations. DRAGONIS's collection of your user information will comply with relevant laws and regulations. 4.2 You fully understand and agree that DRAGONIS or its cooperating third parties may provide you with various information about DRAGONIS services, such as activity information, promotion information, etc., through SMS, phone, email, and other means based on your user information. 4.3 Protecting user information and privacy is a fundamental principle of DRAGONIS. Unless otherwise specified in this agreement, the collection, use, and protection of user information by DRAGONIS Services will comply with the relevant privacy policies uniformly published by DRAGONIS. 5、 DRAGONIS Service 5.1 Subject to your compliance with this Agreement and relevant laws and regulations, DRAGONIS grants you a personal, non transferable, and non exclusive license to use DRAGONIS Services. You may only use Douyu gaming services for non-commercial purposes, including: (1) Receive, download, install, launch, upgrade, log in, display, run, and/or screenshot the DRAGONIS software; (2) Create game characters, set usernames, view game rules, user profiles, game match results, open game rooms, set game parameters, purchase and use game props, equipment, game coins, etc. in the game, use chat and social sharing functions; (3) Use one or more other features supported and allowed by DRAGONIS software. 5.2 During the use of DRAGONIS services, you are not allowed to record or disseminate DRAGONIS service content to others in any way without the permission of DRAGONIS, including not using any third-party software for online dissemination. 5.3 In the event that the game services provided by DRAGONIS include the provision of DRAGONIS software, you shall also comply with the provisions of Article 6 of this Agreement regarding software licensing when using DRAGONIS services. 5.4 All other rights not expressly authorized by this clause and other provisions of this agreement shall still be reserved by DRAGONIS, and you shall obtain written permission from DRAGONIS separately when exercising these rights. 5.5 If DRAGONIS discovers or receives reports or complaints from others that users violate the provisions of this agreement, DRAGONIS has the right to delete the relevant content at any time without notice, and impose penalties on the violating game account, including but not limited to warnings, restrictions or prohibitions on the use of all or part of the functions, game account suspension or cancellation, depending on the circumstances of the behavior, and announce the results of the handling. 5.6 You fully understand and agree that DRAGONIS has the right to punish any behavior that violates relevant laws and regulations or the provisions of this agreement based on reasonable judgment, take appropriate legal actions against any user who violates laws and regulations, and report relevant information to relevant departments in accordance with laws and regulations. Users shall bear all legal responsibilities arising therefrom alone./span> 5.7 You fully understand and agree that you shall be solely responsible for any claims, demands or losses claimed by third parties due to your violation of the provisions of this Agreement or relevant service terms; If DRAGONIS suffers losses as a result, you should also compensate accordingly. 5.8 You fully understand and agree that game props, game equipment, game coins, etc. are part of the game services provided by DRAGONIS. DRAGONIS hereby grants you the right to use them in accordance with this agreement. You shall comply with the requirements of this agreement and the specific rules of the game when purchasing and using game props, game equipment, game coins, etc; At the same time, game props, game equipment, game coins, etc. may be limited by a certain validity period. If you do not use them within the specified validity period, except for force majeure or reasons attributable to DRAGONIS, once the validity period expires, they will automatically become invalid. You fully understand and agree that in order to better provide DRAGONIS services to users, DRAGONIS has the right to adjust, update, or optimize the performance and related numerical settings of game equipment and other game props that you have purchased or are currently using. If DRAGONIS makes corresponding adjustments, updates or optimizations, you agree not to hold DRAGONIS legally responsible for this. 5.9 You fully understand and agree that in order to create a fair and healthy gaming environment, DRAGONIS has the right to use technical means to understand the random storage memory of your terminal device and related programs running simultaneously with DRAGONIS Services during your use of DRAGONIS Services. Once any unauthorized program that endangers the normal provision of game services by DRAGONIS is discovered, DRAGONIS will collect all relevant information and take reasonable measures to crack down on it. 5.10 You fully understand and agree that in order to ensure the gaming speed of you and other users, DRAGONIS has the right to periodically transfer or clear some past game data stored on the server. 5.11 DRAGONIS will take practical and effective measures to protect the legitimate rights and interests of minors in the process of using DRAGONIS services in accordance with relevant laws and regulations and the provisions of this agreement, including possible technical measures, prohibiting minors from accessing inappropriate games or game functions, restricting minors' game time, and preventing minors from becoming addicted to the internet. As part of the game rules, DRAGONIS will also publish relevant game user guidelines and warning instructions in appropriate locations, including game content introduction, correct game usage methods, and methods to prevent harm from occurring. All underage users should carefully read and follow these guidelines and instructions under the guidance of their guardians; Other players should avoid publishing or generating any content that is harmful to the physical and mental health of minors while using DRAGONIS services, and work together to create a healthy gaming environment. 5.12 In order to operate the game server normally, DRAGONIS needs to regularly shut down and maintain the game server or conduct emergency shutdown maintenance in case of unexpected events; When one or more of the following situations occur, DRAGONIS has the right to suspend or interrupt all or part of the services provided by the game server. DRAGONIS shall not be liable to you or any third party for any inconvenience or damage caused as a result: (1) Regular inspections or construction, software and hardware updates, etc., DRAGONIS has the right to suspend services, but DRAGONIS will complete maintenance and update work as soon as possible; (2) The game server has suffered damage and cannot operate normally; (3) Sudden software and hardware equipment and electronic communication equipment failures; (4) Network provider line or other faults; (5) In emergency situations, in accordance with legal regulations or for the personal safety of you or others; (6) Third party reasons or other force majeure situations. 5.13 If you are under the age of 18, in order to protect your legitimate rights and interests, DRAGONIS has the right to take one or more of the following measures in accordance with relevant national laws, regulations and policy provisions, other provisions of this agreement, or reasonable requests from your guardian: (1) Provide your guardian with information related to your game (including but not limited to your game account login information, recharge history information, etc.), so that your guardian can timely or synchronously understand your game situation; (2) Limit the spending limit of your game account; (3) Take technical measures to block certain games or certain functions of games, or limit your gaming time or duration; (4) Cancel or delete your game account and related information such as game data; (5) Other measures requested by your guardian and deemed appropriate by DRAGONIS. 6、 Software License 6.1 Using DRAGONIS services may require downloading and installing relevant software. You can obtain the software directly from the relevant websites of DRAGONIS or from third parties authorized by DRAGONIS. If you obtain the DRAGONIS software or a game with the same name as the DRAGONIS software from a third party without authorization from DRAGONIS, it will be deemed that you have not obtained authorization from DRAGONIS. DRAGONIS cannot guarantee that the game can be used normally and will not be responsible for any losses caused to you as a result. 6.2 DRAGONIS may have developed different software versions for different terminal devices or operating systems, including but not limited to multiple application versions such as Windows, iOS, Android, Windows Phone, Symbian, Blackberry, etc. You should choose to download the appropriate version for installation according to the actual situation. After downloading the installation program, you need to follow the steps prompted by the program to install it correctly. 6.3 If DRAGONIS Services are provided in software form, Douyu grants you a personal, non transferable, and non exclusive license. You can only download, install, log in, and use this DRAGONIS service on a single terminal device for non-commercial purposes.
6.5 If you no longer need to use the software or need to install a new version, you can uninstall it yourself. If you are willing to help DRAGONIS improve its product services, please inform us of the reason for uninstallation. 6.6 In order to ensure the security and consistency of the functions of DRAGONIS Services, DRAGONIS has the right to update the software or change or restrict some of the functions and effects of the software without special notice to you. 6.7 After the release of a new version of the 6.7 software, older versions of the software may not be usable. DRAGONIS does not guarantee the continued availability of old versions of software and corresponding customer service. Please check and download the latest version at any time. 7、 User behavior norms 7.1 You fully understand and agree that you must be responsible for all actions under your game account, including any content you post and any consequences arising therefrom. You should make your own judgment on the content of DRAGONIS Services and bear all risks arising from the use of DRAGONIS Services, including risks arising from reliance on the correctness, completeness, or practicality of DRAGONIS Services content. DRAGONIS cannot and will not be liable for any loss or damage caused by the aforementioned risks. 7.2 In addition to using DRAGONIS Services in accordance with the provisions of this agreement, you shall not engage in any behavior that infringes on the intellectual property rights of DRAGONIS Services, or engage in any other behavior that damages the legitimate rights and interests of DRAGONIS or other third parties. 7.3 Unless permitted by law or written permission from DRAGONIS, you are not allowed to engage in the following behaviors: (1) Delete copyright information from game software and its copies; (2) Reverse engineer, disassemble, decompile, or otherwise attempt to discover the source code of game software; (3) Scan, explore, and test game software to detect, discover, and search for potential bugs or weaknesses; (4) Copy, modify, add, delete, mount, or create any derivative works of game software or data released into any terminal memory during software operation, interaction data between client and server during software operation, and system data necessary for software operation, including but not limited to using plugins, plug-ins, or unauthorized third-party tools/services to access software and related systems; (5) Modifying or forging instructions and data during software operation, adding, deleting, or altering software functions or effects, or operating or disseminating software or methods used for the aforementioned purposes to the public, regardless of whether the aforementioned actions are for commercial purposes; (6) Using third-party software, plugins, cheats, and systems not developed or authorized by DRAGONIS, using DRAGONIS services, or creating, publishing, and disseminating third-party software, plugins, cheats, and systems not developed or authorized by DRAGONIS; (7) Use, rent, lend, copy, modify, link, repost, compile, publish, publish, and establish mirror sites for the content owned by DRAGONIS in the game; (8) Establish mirror sites related to DRAGONIS services, or take web page (network) snapshots, or use methods such as setting up servers to provide others with services that are identical or similar to DRAGONIS services; (9) Separate any part of the Douyu gaming service for separate use, or engage in other non compliant uses under this agreement; (10) Using, modifying, or covering up the name, trademark, or other intellectual property of DRAGONIS Services; (11) Other behaviors without explicit authorization from DRAGONIS. 7.4 If you engage in any of the following behaviors while using DRAGONIS Services, DRAGONIS has the right to take measures, including but not limited to warning, restricting or prohibiting the use of all or part of the functions, temporarily or permanently prohibiting login (i.e. account suspension), deleting game accounts and game data, deleting relevant information, etc., based on the severity of the circumstances and in accordance with the provisions of this agreement and relevant game rules. If the circumstances are serious, it will be handed over to relevant administrative authorities for administrative penalties, or your criminal responsibility will be pursued: (1) The act of implying or falsely claiming to be an internal employee or a special identity of DRAGONIS in some way, attempting to obtain improper benefits or affect the rights of other users; (2) Using illegal or inappropriate words, characters, etc. in DRAGONIS services, including for character naming; (3) Disrupting or affecting the normal operation of DRAGONIS Services in any way; (4) Various illegal cheating behaviors; (5) Spreading illegal speech or inappropriate information; (6) Stealing or obtaining others' game accounts or game items through fraudulent activities; (7) Engaging in unauthorized trading of game accounts; (8) Engaging in unauthorized transactions of game virtual currency, game equipment, game currency, and other game props; (9) Violation of any provisions of this agreement; (10) Other misconduct widely recognized within the industry, whether or not explicitly listed in this agreement or the game rules. 7.5 You acknowledge and agree that if DRAGONIS takes measures to suspend your game account in accordance with this agreement, the specific suspension period shall be determined by DRAGONIS based on the severity of your violation. You acknowledge and agree that: (1) During the account suspension period, the game virtual currency, game equipment, game currency, and other game props in your game account may not be usable; (2) As mentioned earlier, game virtual currency, game equipment, game currency, and other game props have a certain validity period, which may expire during the account suspension period. After your game account is unblocked, you will not be able to use such expired game virtual currency, game equipment, game currency, and other game props. Accordingly, you also agree not to pursue any legal responsibility against DRAGONIS for the occurrence of the situations specified in points (1) and/or (2) above. 8、 Disclaimer 8.1 DRAGONIS Services are provided to you on an "as is" basis. DRAGONIS does not guarantee that DRAGONIS Services are error free and uninterrupted, that all defects have been corrected, or that DRAGONIS Services will not be damaged by viruses or any other factors. Unless otherwise expressly provided by law, DRAGONIS hereby declares that it does not assume any express or implied warranty liability, including but not limited to warranties of performance, applicability, or non infringement of DRAGONIS services. 8.2 In any case, DRAGONIS shall not be liable for any losses suffered by you during the use of DRAGONIS services due to force majeure. Such force majeure events include but are not limited to national laws, regulations, policies, orders from state organs, other government actions, or other unpredictable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, wars, etc. 8.3 DRAGONIS may independently decide to change, terminate, or suspend your use of any DRAGONIS services at any time without giving you any prior notice, except as required by laws and regulations or your agreement with DRAGONIS. If your behavior violates the provisions of laws and regulations or the provisions of this agreement, and DRAGONIS terminates or suspends your use of any DRAGONIS services in accordance with relevant regulations, DRAGONIS shall not be liable to you and has the right to demand that you assume corresponding responsibilities. 8.4 DRAGONIS Services may cause abnormal account data such as game characters, game props, game equipment, and game coins due to game software bugs, version update defects, third-party virus attacks, or any other factors. DRAGONIS will take timely remedial measures for this. Until the cause of the abnormal data is identified, DRAGONIS has the right to temporarily freeze the game account; If it is found that the data abnormality is abnormal gaming behavior, DRAGONIS has the right to restore the game account data to its original state before the abnormality occurred (including recovering the transferred data from third parties), and DRAGONIS does not need to bear any responsibility to you. 8.5 DRAGONIS does not authorize you to obtain game accounts, game props, game equipment, game coins, etc. from any third party through purchase, acceptance of gifts, or other means. DRAGONIS is not responsible for the behavior of third-party transactions and does not accept appeals arising from disputes arising from any third-party transactions. 8.6 You fully understand that the advertisements, links, or other forms of promotional content placed by third parties in DRAGONIS Services are provided by them themselves, and you should judge their authenticity on your own. DRAGONIS does not make any express or implied warranties regarding their promotional content. 8.7 You fully understand that there is an objective situation of interoperability between different operating systems, which is not caused by DRAGONIS. This may result in your recharge and game data being unable to be smoothly transferred from one operating system to another. The risk of recharge loss and game data loss caused by switching between different systems shall be borne by you, and DRAGONIS shall not be held responsible for any liability. 8.8 You fully understand that the Douyu gaming service may set up mandatory battle zones or gameplay. If you do not agree to mandatory battles, please do not enter the game or game zone; Your entry will be deemed as agreeing to the gameplay and accepting the corresponding consequences. 9、 Intellectual Property 9.1 Unless otherwise specified, DRAGONIS is the intellectual property owner of DRAGONIS Services. All copyrights, trademarks, patents, trade secrets and other intellectual property rights related to DRAGONIS Services, as well as all information content related to DRAGONIS Services (including text, images, audio, video, charts, interface design, layout framework, relevant data or electronic files, etc.), are protected by the laws and regulations of the People's Republic of China and corresponding international treaties. DRAGONIS enjoys the above-mentioned intellectual property rights, except for the rights that the relevant rights holders should enjoy according to legal provisions. 9.2 The ownership and intellectual property rights of the game data generated by your use of DRAGONIS Services belong to DRAGONIS, and DRAGONIS has the right to dispose of such game data. 9.3 DRAGONIS Services may involve third-party intellectual property rights, and if such third parties have requirements for you to use such intellectual property rights in DRAGONIS Services based on this agreement, DRAGONIS will inform you of such requirements in an appropriate manner, and you should comply with them. 10、 Comply with local laws and regulations 10.1 You shall comply with relevant local laws and regulations, and respect local morality and customs when using DRAGONIS services. If your behavior violates local laws, regulations or moral customs, you should bear independent responsibility for it. 10.2 You should avoid involving DRAGONIS in political and public events due to the use of DRAGONIS Services, otherwise DRAGONIS has the right to suspend or terminate its services to you. 11、 Jurisdiction and Application of Law 11.1 This agreement is signed in Minhang District, Shanghai, People's Republic of China. 11.2 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of mainland China (excluding conflict of laws). 11.3 If any disputes or controversies arise between you and DRAGONIS due to this agreement (including but not limited to contract or other property rights disputes), they should first be resolved through friendly negotiation; If the negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction over the place where this agreement is signed. 11.4 The headings of all clauses in this agreement are for convenience of reading only and do not have any actual meaning in themselves, and cannot serve as a basis for interpreting the meaning of this agreement. 11.5 Regardless of the reason for partial invalidity of this agreement, the remaining provisions shall remain valid and binding on all parties. 12、 Other 12.1 According to the advice of the State Administration of Press and Publication on healthy games, DRAGONIS reminds you to resist unhealthy games and refuse pirated games; Pay attention to self-protection and beware of being deceived; Moderate gaming benefits the brain, while addiction to gaming harms the body. 12.2 Unless you have read and accepted all the terms of this agreement, you have no right to use DRAGONIS Services. By using DRAGONIS Services, you are deemed to have read and agreed to sign this agreement. Afterwards, you shall not raise any form of defense on the grounds of not reading/agreeing to the content of this agreement or similar reasons.
