Section 4:Content Guidelines
1.The term “content” in this section refers to any content created, uploaded, copied, published, or transmitted by users during their use of the service. This includes, but is not limited to, account avatars, usernames, user descriptions, registration information and authentication materials, as well as messages and linked pages sent, replied to, or auto-replied in text, voice, image, video, or graphic form. It also includes any other content generated through the use of the account or the service.
2. Users are prohibited from using the “DRAGONIS” account or services to create, upload, copy, publish, or disseminate content that is prohibited by laws, regulations, or policies, including but not limited to:
(1) Content that opposes the fundamental principles established by the Constitution;
(2) Content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
(3) Content that harms the honor and interests of the state;
(4) Content that incites ethnic hatred or discrimination, or undermines national unity;
(5) Content that undermines state religious policy, or promotes cults and feudal superstitions;
(6) Content that spreads rumors, disrupts social order, or undermines social stability;
(7) Content involving obscenity, pornography, gambling, violence, murder, terrorism, or instigation of crime;
(8) Content that insults or slanders others, or infringes on the legal rights of others;
(9) Content that violates the “Seven Bottom Lines” policy, including legal bottom line, socialist system bottom line, national interest bottom line, citizens’ legal rights bottom line, public order bottom line, moral conduct bottom line, and information authenticity bottom line;
(10) Other content prohibited by laws or administrative regulations.
3. Users are also prohibited from using the “DRAGONIS” account or services to create, upload, copy, publish, or disseminate content that interferes with the normal operation of “DRAGONIS” or infringes upon the legitimate rights and interests of other users or third parties, including but not limited to:
(1) Content containing any form of sexual or sexually suggestive material;
(2) Content that includes insults, threats, or intimidation;
(3) Content involving harassment, spam, malicious information, or phishing attempts;
(4) Content that invades others’ privacy or contains personal information or data;
(5) Content that infringes upon the reputation, portrait rights, intellectual property rights, or trade secrets of others;
(6) Other content that disrupts the service’s operation or infringes on the rights of others.
Section 5: Usage Rules
1.Any content transmitted or published by users through this service does not reflect or represent, and shall not be considered to reflect or represent, the views, positions, or policies of DRAGONIS. DRAGONIS assumes no responsibility for such content.
2.Users may not use the "DRAGONIS" account or the service to conduct any of the following behaviors:
(1) Submitting or publishing false information, or misappropriating others’ avatars or personal information to impersonate or act in the name of others;
(2) Forcing or inducing other users to follow, click links, or share information;
(3) Fabricating facts or concealing the truth to mislead or deceive others;
(4) Using technical means to create fake accounts in bulk;
(5) Using the "DRAGONIS" account or the service for illegal or criminal activities;
(6) Producing, publishing, operating, or disseminating methods or tools related to the above acts, regardless of whether for commercial purposes;
(7) Using third-party discount top-up agents (i.e., providing account/password to others to top up game currency);
(8) Other behaviors that violate laws and regulations, infringe upon the legitimate rights of others, interfere with normal operations of "DRAGONIS", or are unauthorized by DRAGONIS.
3.Users are solely responsible for the authenticity, legality, harmlessness, accuracy, and validity of the information transmitted through their "DRAGONIS" account or the service. Users shall bear all legal liability for such information, and DRAGONIS shall bear no responsibility. If such behavior causes loss to DRAGONIS or a third party, the user shall compensate accordingly.
4.The services provided by DRAGONIS may include advertisements. Users agree that during usage, advertisements provided by DRAGONIS and third-party suppliers or partners may be displayed. Except where explicitly provided by law, users shall be solely responsible for transactions based on such advertisements. DRAGONIS assumes no liability for any losses or damages resulting from such transactions or content.
5.Users are not allowed to use DRAGONISs' products and services or participate in DRAGONISs activities through improper or other unfair means. Users are not allowed to interfere with the normal provision of products and services by DRAGONISs, including but not limited to: attacking, infiltrating DRAGONISs' website servers, or overloading website servers; Crack and modify the client program provided by DRAGONISs; Attacking, infiltrating game servers or game server-side programs of DRAGONISs, or overloading game servers; Create, publish, disseminate, and use any form of auxiliary tools or programs (cheats) that impede the fairness of the game; Exploiting program vulnerabilities and bugs to disrupt the normal functioning of the game or propagate such vulnerabilities or bugs; Unreasonable interference or obstruction of others' use of the products and services provided by our company; Using third-party recharge providers for recharging causes damage to the interests of our company; Using third-party software, plugins, cheats, and systems not developed or authorized by Douyu, using DRAGONISs and DRAGONIS services, or creating, publishing, and disseminating third-party software, plugins, cheats, and systems not developed or authorized by Douyu.
In order to maintain the fairness of the game, if DRAGONISs discovers abnormal user data, regardless of whether the user is at fault for the abnormal data, DRAGONISs has the right to take corresponding measures in accordance with this agreement, game conventions, player rules, and game announcements released from time to time, including but not limited to banning, terminating, and deleting the account; The user hereby undertakes that DRAGONISs has the right to engage in the above-mentioned behavior and promises not to demand any compensation or refund from DRAGONISs for the above-mentioned behavior.
6. If you engage in any of the following behaviors while using DRAGONIS services, Douyu has the right to temporarily or permanently prohibit your login (i.e. ban your account), delete your game account and game data, delete related information, etc. in accordance with the provisions of this agreement and relevant game rules, depending on the severity of the circumstances. If the circumstances are serious, you will be handed over to the relevant administrative authorities for administrative penalties, or your criminal responsibility will be pursued:
(1) The act of implying or falsely claiming to be an internal employee or a special identity of Douyu in some way, attempting to obtain improper benefits or affect the rights of other users;
(2) Using illegal or inappropriate words, characters, etc. in the game, including for character naming;
(3) Disrupting DRAGONISs in any way or affecting the normal operation of DRAGONISs services;
(4) Various illegal cheating behaviors;
(5) Spreading illegal speech or inappropriate information;
(6) Stealing others' game accounts and game items;
(7) Engaging in unauthorized trading of game accounts;
(8) Engaging in unauthorized transactions of game virtual currency, game equipment, game currency, and other game props;
(9) Violation of any provisions of this agreement;
(10) Other misconduct widely recognized within the industry, whether or not explicitly listed in this agreement or the game rules.
You acknowledge and agree that due to the concealment or disappearance of cheats after use, Douyu has the right to determine whether you have used illegal cheats based on your game data and abnormal performance.
7. You acknowledge and agree that if DRAGONISs takes measures to suspend your game account in accordance with this agreement, the specific suspension period shall be determined by DRAGONISs based on the severity of your violation.
You acknowledge and agree that: (1) During the account suspension period, the game virtual currency, game equipment, game currency, and other game props in your game account may not be usable; (2) As mentioned earlier, game virtual currency, game equipment, game currency, and other game props have a certain validity period, which may expire during the account suspension period. After your game account is unblocked, you will not be able to use such expired game virtual currency, game equipment, game currency, and other game props. Accordingly, you also agree not to pursue any legal responsibility for DRAGONISs due to the occurrence of the situations specified in points (1) and/or (2) above.
Section 6.Account Management
1.The ownership of "DRAGONIS" accounts belongs to DRAGONIS. After completing the application and registration process, users obtain the right to use the "DRAGONIS" account, which is exclusively granted to the initial registrant. Commercial uses such as gifting, borrowing, renting, transferring, or selling are strictly prohibited. Otherwise, you shall bear all legal consequences and responsibilities arising therefrom, and Douyu reserves the right to take measures against your game account, including but not limited to issuing warnings, restricting or prohibiting the use of all or part of the game account functions, deleting the game account and game data as well as other relevant information, suspending the account, or even canceling it. You shall bear all consequences resulting from such actions. You understand and agree that DRAGONIS has the right to reclaim users' "DRAGONIS" accounts for operational needs.
2.Users may modify or delete personal information, registration details, and transmitted content on their "DRAGONIS" accounts. However, please note that deleting such information will also result in the deletion of text and images stored by the user in the system. Users shall bear the risks associated with such deletions.
3.Users are responsible for safeguarding the security of their registered account information and passwords. Any loss or theft of the account or password due to inadequate safeguarding by the user shall be the user's own responsibility. Users shall be legally responsible for all actions taken under their registered accounts and passwords. Users agree not to use other users' accounts or passwords under any circumstances. If users suspect that their accounts or passwords are being used by others, they agree to immediately notify DRAGONIS. When notifying Douyu, users shall provide valid personal identification information that matches their registered identity information. Upon receiving a valid request from the user and verifying their identity, Douyu will take appropriate measures as requested by the user or based on the specific circumstances (including but not limited to suspending the login and use of the account). Any losses incurred by users or other users as a result of Douyu taking measures in response to the user's request shall be borne by the user. If the user fails to provide valid identification information or the provided information does not match the registered identity information, Douyu reserves the right to refuse the user's request, and any resulting losses shall be borne by the user.
4.Users shall comply with all terms of this agreement and use the service correctly and appropriately. If a user violates any terms of this agreement, DRAGONIS has the right to interrupt or terminate the service provided to the violating user's "DRAGONIS" account after notifying the user. Additionally, DRAGONIS reserves the right to reclaim "DRAGONIS" accounts and usernames at any time.
5.If a user does not log in to their "DRAGONIS" account for one year after registration, DRAGONIS may reclaim the account after notifying the user to avoid resource wastage. Any adverse consequences arising therefrom shall be borne by the user.
6.DRAGONIS will impose account sanctions on players who violate game management regulations in accordance with this agreement and specific provisions such as relevant service policies, cheating software handling procedures, account theft handling procedures, and procedures for handling the use of third-party recharge merchants.
7.If users use a third-party account recognized by Douyu as their game account to use and enjoy DRAGONIS services, users shall also comply with the agreements and rules related to that third-party account. For any issues arising from the third-party account, including but not limited to theft, users shall contact the third party directly for resolution. Douyu shall not be held responsible for such issues in principle.
Section 7.Data Storage
1.DRAGONIS shall not be held responsible for the deletion or failure to store user data related to this service.
2.DRAGONIS will retain purchase records of in-game virtual currency in accordance with the relevant provisions of the "Interim Measures for the Administration of Online Games" issued by the Ministry of Culture. For the storage of other game data, DRAGONIS may determine the maximum storage period for user data in this service based on actual circumstances and allocate the maximum data storage space on its servers accordingly. Users may back up relevant data in this service as needed.
3.If a user stops using this service or if this service is terminated, DRAGONIS may permanently delete the user's data from its servers. After the cessation or termination of this service, DRAGONIS shall have no obligation to return any data to the user.
Section 8.Risk Assumption
1.Users understand and agree that "DRAGONIS" merely provides a platform for online gaming services, and users must be responsible for all actions taken under their registered accounts, including any content transmitted and any consequences arising therefrom. Users shall independently judge the content on "DRAGONIS" and this service and assume all risks associated with the use of such content, including risks arising from reliance on the accuracy, completeness, or usefulness of the content. DRAGONIS cannot and will not assume responsibility for any losses or damages caused by user actions.
If users discover anyone violating this agreement or using this service in an improper manner, they should immediately report or complain to DRAGONIS, which will handle the matter in accordance with this agreement.
2.Users understand and agree that DRAGONIS reserves the right to unilaterally change, suspend, terminate, or revoke all or part of the service content of this service due to business development needs, and users shall assume this risk.
Section 9.Intellectual Property Statement
1.Except for the intellectual property rights of advertisements featured in this service, which are owned by the respective advertisers, the intellectual property rights of the content provided by DRAGONIS in this service (including but not limited to web pages, text, images, audio, video, graphics, etc.) shall be owned by DRAGONIS, unless the user has legally obtained intellectual property rights for the content they publish before using this service.
2.Unless otherwise specifically stated, the copyright, patent rights, and other intellectual property rights of the software used by DRAGONIS to provide this service shall be owned by DRAGONIS.
3.The graphics, text, or their combinations involved in this service by DRAGONIS, as well as other DRAGONIS logos and product and service names (hereinafter collectively referred to as "DRAGONIS Identifiers"), shall have their copyright or trademark rights owned by DRAGONIS. Without the prior written consent of DRAGONIS, users shall not display, use, or otherwise dispose of DRAGONIS Identifiers in any way, nor indicate to others that they have the right to display, use, or otherwise dispose of DRAGONIS Identifiers.
4.The aforementioned and any other intellectual property rights legally owned by DRAGONIS or relevant advertisers are protected by law. Without the written permission of DRAGONIS or relevant advertisers, users shall not use them in any form or create derivative works related to them.
Section 10.Legal Liability
1.If DRAGONIS discovers or receives reports or complaints from others regarding a user's violation of this agreement, DRAGONIS reserves the right to review and delete relevant content at any time without notice, including but not limited to user accounts, user profiles, and chat records. Depending on the severity of the violation, DRAGONIS may impose penalties on the offending account, including but not limited to warnings, account bans, device bans, and feature bans, and will notify the user of the outcome of such actions.
2.Users whose accounts have been banned for violating the user agreement can check the ban duration at http://immomo.com/my and unban themselves after the ban period expires. Users subjected to feature bans will have the banned features automatically restored upon the expiration of the ban period. Banned users may submit an appeal on the relevant pages of the DRAGONIS website. DRAGONIS will review the appeal and make a reasonable judgment on whether to modify the penalty measures.
3.Users understand and agree that DRAGONIS has the right to impose penalties, based on reasonable judgment, for violations of relevant laws, regulations, or this agreement, and to take appropriate legal action against any users who violate laws and regulations. DRAGONIS may also save relevant information and report it to relevant authorities in accordance with laws and regulations, and users shall bear all legal responsibilities arising therefrom.
4.Users understand and agree that if, due to a user's violation of this agreement, any third party claims any compensation, demands, or losses, including reasonable attorney's fees, the user shall indemnify and hold harmless DRAGONIS, its partner companies, and affiliated companies.
Section 11.Miscellaneous
1.All notices sent by DRAGONIS to users may be delivered through announcements on important pages, emails, or regular mail.
2.DRAGONIS solemnly reminds users to pay attention to the clauses in this agreement that exempt DRAGONIS from liability and limit user rights. Users are requested to read carefully and consider the risks independently. Minors should read this agreement accompanied by their legal guardians.
3.The validity, interpretation, and dispute resolution of this agreement shall be governed by the laws of the People's Republic of China. If any disputes or controversies arise between the user and DRAGONIS, they shall first be resolved through friendly negotiation. If negotiation fails, the user agrees to submit the dispute or controversy to the competent court in the jurisdiction where DRAGONIS is located.
4.If any provision of this agreement is found to be invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding on both parties.
